The Supreme Courtroom Tuesday mentioned unauthorised constructions can’t be legitimised merely as a result of administrative delays, passage of time, or financial investments and issued a slew of instructions to curb unlawful constructions.
A bench comprising Justices J B Pardiwala and R Mahadevan mentioned, “We’re of the opinion that building(s) put up in violation of or deviation from the constructing plan accredited by the native authority and the constructions that are audaciously put up with none constructing planning approval, can’t be inspired. Each building have to be made scrupulously following and strictly adhering to the foundations.”
“Delay in directing rectification of illegalities, administrative failure, regulatory inefficiency, negligence and laxity on a part of authorities involved in performing their obligation(s) below the Act, can’t be used as a defend to defend motion in opposition to unlawful/ unauthorised constructions,” it mentioned.
